The High Court has found a class three boy guilty of murdering his 11-year-old "girlfriend".

Justice Christine Meoli dismissed defence by the 12-year-old that dark forces instructed him to stab the girl thrice as the two had sex.

The court however ruled that the accused was also experiencing a difficult childhood within a dysfunctional family and ordered that he be sent to Kimumu junior probation centre for three years.

The pupil from Kinangop was being charged with murder after he stabbed his "girlfriend" to death on July 5 last year in Kibuyu village of Magumu.

Represented by lawyer Francis Mburu, the boy told the court that as he was getting intimate with the girl, a 'tall man armed with a machete' and a shiny knife appeared and ordered him to kill her.

But in her ruling, the court dropped the boy's defence and described it as incredible.

"The accused defence is unbelievable, conjured to absolve him and the prosecution has proven the case beyond any reasonable doubt," she said.

She however noted that that it would be unfair to take the minor back to his 'harsh background' he had been raised in since he needed counseling and education.

"There is no need to send the boy back to the dysfunctional background but to a place where he can be rehabilitated," she ruled.
