Chief Justice David Maraga has appointed a three-judge bench seeking to block construction of Sh38 billion Itare Dam in Kuresoi South, Nakuru county.

This will be the beginning of addressing the controversy surrounding the multi-billion projected that was initiated by President Uhuru Kenyatta's government.

The case was forwarded to Maraga after elders from nine counties sought his intervention on the development project which they termed as a looming disaster given that it will be built within the Mau water catchment area thus depriving the nine counties water as their rivers flow through the Mau forest water tower.

“The matter is of public interest as it touches on nine counties making it weighty and more sensitive. We want the Chief Justice to intervene and help in deciding on the fate of the water dam,” said Mwamu in June.

The nine counties include, Kisumu, Migori, Homa Bay, Siaya, Kisii, Nyamira, Narok, Bomet and Kericho.
