The Independent Electoral and Boundaries Commission (IEBC) has said Machakos governor aspirant Wavinya Ndeti is guilty of party hopping and should therefore be barred from running in the next elections.

Through lawyer Paul Nyamodi, the commission on Friday told Justice George Odunga that the Machakos gubernatorial aspirant did not resign from her Chama Cha Uzalendo Party before moving to Wiper as required by the law.

The lawyer further told the court that going by the date of Wavinya's purported resignation (April 6), the aspirant Wavinya was still a member of her old party, and that she only made a futile step to leave using a coalition of agreement.

“Wavinya only became a member of Wiper Party on the April 24, 2017, when her party CCU entered into a coalition agreement with Wiper party,” Nyamodi told court.

The IEBC added that the said coalition agreement between Wiper and CCU did not meet the threshold requirement for resignation from one party.

The commission said Wavinya was therefore inelligible to be nominated in any party to contest for any seat in the general election.

“The grounds made by Wavinya in this case including that of legitimate expectations have not been proven, and for those reasons the application for judicial review should be dismissed with costs,” Nyamodi said.
